Fee Schedule
CDR-Crash Data Retrieval 1. CDR Download and or Delivery of CDR information to the Client are charged a flat fee of $450.00, plus travel time and expenses. CDR Storage is negotiated on case-by-case bases. 2. ECM Download from commercial vehicles are by quote with a minimum fee of $1,500.00 per vehicle, plus travel time and expenses. This is for delivery of a copy of the data and NOT for data analysis. Accident Reconstruction 3. All general research, calculations, reports, drawings, photographs, inspections, maps or any and all other work product (including phone consultations lasting longer than 10 minutes) are charged at a rate of $350.00 per hour ( 1 (one) hour minimum). Partial hourly increments are rounded to the nearest ½ hour. 4. All travel time is charged at a flat rate of $140.00 per hour plus any and all associated travel expenses plus mileage. 5. Mileage expense of .90 cents per mile is charged for vehicle travel out side of the Las Vegas Metro area. 6. Expenses for travel, lodging, food and any other associated travel expenses (including mileage) during out-of-area travel is calculated on a case-by-case basis. 7. All clerical work is charged at a flat rate of $80.00 per hour with a 2 hour minimum, rounded to the nearest ½ hour. 8. Any miscellaneous work product fees incurred are calculated on a case-by-case basis. Storage fees are calculated on a case-by-case basis. Expert Witness 10. If JH & A Expert or Associate employed by JH & A is deposed/disclosed/declared/subpoenaed/summoned/contracted as an Expert, Expert Witness, Expert Witness Disclosure/deposition fee of $1,200.00 (three hour minimum) is due from the deposing/requesting/declaring/summoning/commanding entity or Client (s). This non-refundable fee is due upon invoice (see OTHER) or 2 weeks (14 days including holidays) before any scheduled appearance date, which ever comes first.
11. There is a 1 (one) day (10 hour) minimum for any court appearance. Partial hourly increments above the 10 hour minimum (overage) for that day are rounded to the nearest ½ hour. JH & A Expert & Associate Witness deposition/testimony/event fees are charged at $400.00 per hour per day after any/all minimums have been met. 12. The first day’s minimum testimony fees are due upon presentation of an Invoice by JH & A Expert or Associate to the deposing/requesting/commanding/ summoning/declaring/contracting entity prior established representative/Client (s) before any JH & A Expert/Associate will go into court (see # 11 sentence 1 & 2). 13. When it is required by the deposing/requesting/commanding/summoning/declaring/contracting entity or Client (s) of a JH & A Expert or Associate next day return, any/all previous days time overage (see # 11) and that specific days appearance is due upon arrival and presentation of a Special Circumstance Invoice by JH & A Expert or Associate to the deposing/requesting/commanding/summoning/declaring/contracting entity or Client (s) prior established representative or Client. 14. Failure to meet any of the above obligations by the deposing/requesting/commanding/summoning/declaring/contracting entity or Client (s) will result in nonappearance and/or cancellation by JH & A with no refund of fees received to date. 15. At our discretion, next day returning JH & A Expert or Associate appearance cancellation penalties incurred are not less than $600.00 or greater than $2400.00 in the event of less than 36 hours written notice by the deposing/requesting/commanding/summoning/declaring/contracting entity or Client (s). 16. Travel and mileages is billed pursuant to above, (see #’s 4, 5, and 6) and at our discretion within the Las Vegas Metro Area. 17. A fee of $600 is due if written cancellation notification is received regarding testimony/deposition/event within 48 hours of the scheduled appearance date by the deposing/requesting/commanding/summoning/declaring/contracting entity or Client (s). 18. Any payment default of fees due to JH & A, in regards to #’s 10 - 17 of the above, becomes the Client (s) responsibility for payment (as per Consultant’s Agreement, unless a written, negotiated, signed (by John Howell or Sydney Wolf of JH&A) addendum is applicable or at our discretion). Any non-compliance by any deposing/requesting/commanding/summoning/declaring/contracting entities other than Client (if Client is in good standing as per JH & A (remove consultants) Agreement) in whole or in part of our Fee Schedule or Consultant’s Agreement by the deposing/requesting/commanding/summing/ declaring/contracting entity or Client (s) will be pursued to the fullest extent allowed by State and or Federal Law. Other 20. Local messenger service is charged at $40.00 per event, non-local messenger service based on costs incurred. 21. Returned checks will be assessed a $50.00 handling fee and a penalty equaling 10% of the present total. 22. Fees are due upon receipt of invoice (s). Balances more than 15 days (including weekends & holidays) late are assessed late fees equaling 10% of the invoice total plus a $25.00 processing fee every 15 days (including weekends & holidays) until paid in full with new balances accruing. 23. JH & A reserves the right to discontinue further work if invoiced balances are not paid within 15 days (including weekends & holidays) of invoice receipt. Failure to meet this obligation will result in non-appearance and/or cancellation by JH & A with no refund of fees incurred to date. |
